Multiple Offenses, Higher Penalties
Louisiana DUI/DWI laws are strict. Below is what you could face upon conviction:
- Second DUI/DWI offense: There is a 30-day to 6-month jail sentence and a mandatory 48-hour jail sentence. In addition, you are subject to steep fines, court costs, probation and community service. Your driver’s license will be suspended, and you will have to install an interlock device to be able to drive.
- Third DUI/DWI offense: This is a felony DWI offense in Louisiana and a 1 to 5-year jail sentence. You will serve a mandatory year in jail. Your license will be suspended, and you will need to have an ignition interlock device installed in order to drive. You may face intensive probation, mandatory community service and participation in substance abuse programs if you do not serve the entire jail sentence. Your vehicle will also be seized by the State.
- Fourth DUI/DWI offense: This is a felony DWI offense in Louisiana with a jail sentence of 10 to 30-years. There is a mandatory jail term of 2-years. You will pay higher fines and court costs, lose your license, and have to have an ignition interlock device installed in order to drive.
