DEFENDING AGAINST UNFAIR DOMESTIC VIOLENCE CHARGES

On behalf of Craig E. Gibbs, Attorney at Law posted in blog on Wednesday, August 2, 2017.

Every year, thousands of individuals throughout the country face domestic violence charges. It is certainly not a controversial stance to say that domestic violence destroys lives of its victims, but the truth of the matter is that domestic violence charges also destroy lives.

Although thousands of individuals face real danger of ongoing physical harm, many others face their lives crumbling because of the consequences of unjust domestic violence charges.

If you recently received unfair domestic violence charges, you should consider consulting with an experienced attorney who understands the intricacies of defending the rights of those accused of violence.

Depending on the nature of your charges and the circumstances that brought them about, you may have a number of options for defending yourself and your name.

Are your charges untrue?

For many people facing domestic violence charges, the charges themselves are simply not true. This could mean a number of things.

Do you face allegations brought against the wrong suspect? In some cases, violence charges are a matter of being in the wrong place at the wrong time, not any specific wrongdoing. if you believe that your charges rightfully belong to someone else, a defense attorney can help pursue fair dismissal of the charges.

On the other hand, as awful as it is, many partners falsely allege domestic violence against another person as a form of revenge or control. To make these allegations even more complex, they often stem from past experiences where you or another partner did engage in physical violence.

Still, it is not right for a person to allege wrongdoing based on past mistakes, or to wholly fabricate a violent incident. An experienced defense attorney can help you craft a strategy to combat false allegations, to protect your name and your rights.

Do the charges stem from a misunderstanding of the facts?

It is also possible that your charges arose because you did commit some physical act against another person. However, if you only resorted to violence as an act of self-defense, you may have options.

Self-defense claims are complex, but can provide good results with proper preparation.

Finally, it is possible that you and your partner have a particularly aggressive relationship, and the lines between consensual and non-consensual activity simply got too blurry. In these cases, you may have grounds to assert that you are not guilty of domestic violence because the physical encounter that sparked the accusations was a consensual act or set of acts between you and your partner.

As always, you shouldn’t take any chances when it comes to defending your name and future against allegations of violence. Use every tool at your disposal to defend yourself, and don’t wait to seek counsel if you need it.
