HOW TO DEFEND YOURSELF AGAINST A DRUNK DRIVING CHARGE

There is nothing worse than the thought of a DUI conviction on your record. However, many people find themselves in this position.

An arrest for driving under the influence of alcohol is a big deal, so you don’t have any time to waste.

The first thing you need to do is review the arrest, including the details that brought this on. Secondly, it’s time to turn your attention to your current situation, such as how your case will move through the court.

With all this in mind, you must know the many ways to defend yourself against a drunk driving charge. Since you may not know much about the law and your rights, it never hurts to consult with a DUI attorney.

Here are some of the most common defense strategies:

— Improper stop. This is an argument stating that the officer did not have probable cause to pull over your vehicle.

— Accuracy of the field sobriety test. It’s possible that an arrest could be thrown out if it’s found that the officer did not accurately administer the field sobriety test.

— Accuracy of the Breathalyzer test. This is often used to determine if a person’s blood alcohol level is higher than the legal limit. However, just because an officer uses a Breathalyzer test does not mean that he or she did so in an accurate manner.

— Rising blood alcohol concentration. A unique defense strategy, this is when the defense claims that your blood alcohol content level was less than the legal limit when you were driving, but increased before the Breathalyzer test was administered. This often comes into play if the person recently consumed alcohol that has yet to absorb.

There is no way of knowing what type of DUI defense strategy is best until you learn more about each and every option. It goes without saying that the strategy you use depends on the circumstances surrounding your arrest.
